Referendum Question #1 re: Engineering Career Centre Fee Renewal

Whereas​ the employment of four Industry Liaison Managers, an internship manager, and a Recruitment, Events and Communications officer has resulted in 54% of Faculty of Engineering students graduating with at least one 4-month internship or CO-OP work term, and 54% “employed” rated at time of graduation,

 

Whereas​ the Engineering Career Centre (ECC) continues to offer an increase number of career advising appointments, as well as engaging with student groups, clubs and organizations to further increase (i) internship and career opportunities, (ii) career education workshops and seminars, and (iii)
links with industry,

 

Whereas​ the Office of the Dean in the Faculty of Engineering co-funds the ECC and MESC operations,

Referendum Question #2 re: Changes in EUS Constitution Regarding the Board of Governors

Whereas, â€‹the changes listed in Appendix A and B were discussed at length with the Board of Governors, Council, and Executives present in the Constitution working group.


Whereas, ​the Constitution needs upgraded grammar, wording, removal of gendered language, legal terms, punctuation, and numbering.
 

Be it resolved ​that the following question be put to the members in the EUS Winter Referendum Period

For the purposes of this Appendix, the terms Board of Governors, Board, and BoG are used interchangeably to refer to the EUS Board of Governors.

In clause 30.3​ Grammar


In clause 30.5, ​the start dates for the members at large elected will be changed from October to November 1st. Additionally, there will only be 2 members selected from Council (additionally, as originally intended during the creation of the Board, these 2 members will also be selected from Council, not just by Council) instead of 4 in the fall so as to create a majority of elected members within the Board of Governors. The election period is  stated for both the fall (Sept 1st to Oct 31st) and the spring (Feb 1st to March 31st).


In clause 30.6.2, ​the alumni BoG member mandate start time is altered to match the elected members at large to November 1st.


In clause 30.8.1, ​the members of the BoG must disclose that they have specific memberships on committees in such an event that that committee will be discussed. This is to avoid conflicts of interest.


Clause 31.1.2 ​Grammar


In clause 31.1.3, ​when resolutions are defined from Council or from a General Assembly, they are in collaboration with the Executive Committee as it is more likely the Executive will be present at council, for example, should there be a discrepancy.


In clause 31.1.4, ​it outlines that there must be reasonable limits when the BoG mandates and Executive to do a task, such that it is not drastically different from their portfolio given tasks or overstepping bounds.


Former clause 31.1.9 ​was removed, as a list of committees should not be up to the BoG to update, it should be a given as the Executives are in change of committees.


In clause 31.1.9​ Maintain and uphold the purpose and long-term vision of the EUS.

 

In clause 31.1.10, ​a rationale must be given to Executives or to Council should the BoG reverse one of their decisions.


In clause 31.3, ​the amendments made by the BoG to bylaws will be in effect immediately, unless they are overturned by a General Assembly, and at that point the bylaw will revert to its previous are altered state, as stated in accordance with Quebec law.


In clause 32.1, ​ specific positions were removed from quorum as it has proven difficult to obtain quorum due to this clause.


In clause 32.1.1 ​In order to achieve Quorum,​ a member of the Executive Committee​, whether they are a member of the Board of Governors​ or not, must be present.


In clause 32.4​, the minutes of the BoG shall be made public.


In 32.4.1​, a closed session may be called for communication of other sensitive or confidential information, in addition to legal and human resources matters.


In clause 32.6, ​ the rules of order are to be agreed upon by the BoG.


Former clause 33.1, ​was struck as there is always a member of the BoG at regular meetings, as they are supposed to give updates.


Former clause 34.3​ has been moved to clause 34.1​.


Clause 34.2 ​updates the procedure for when the Board Chairperson is selected, such that at the end of their term on the BoG, or in the event that they are removed or resign from office as the board chair. A new Chair shall be selected at the next meeting.

Former Article 35 ​is struck as a faculty advisor (Dean of Students) is not possible in practice, and as the BoG meetings are open (therefore the faculty is able to attend, though is not mandated to).


Clause 44.6 and 44.7 ​is added so that “The Board of Governors​ may remove a member of the Executive Committee​ following the reception of
a Motion​ intended for this effect and carried by a Two-thirds (2⁄3) Majority of the Board.”


By removing former clause 49.3 ​the quorum at the EUS Council is changed back to 1⁄2 of members when the impeachment of a BoG member is being considered.


Clause 49.4 ​allows the General Assembly to remove a member of the BoG by a 2⁄3 majority vote.


58.2​, the BoG will ratify the VP Finance after the selection committee.

 

Article 64​, is changed to allow for the 2 BoG members to be elected in the fall, and the 4 members in the winter.


Clause 73.2 ​ The alumnus can be a past member (associate or regular).
